Default Got into accident, will insurance fix with OEM parts?


Got into an accident, I'm not at fault, going through other guys insurance. The only body shop I'll go to only deals with OEM parts and they gave me a preliminary estimate. Im worried the other guy's insurance will try to fix with aftermarket parts. There's no way I'm putting aftermarket crap on my car. I've dealt with that before and it never fits right and looks cheap. Plus, the parts that are damaged are OEM. Are they obligated to replace with OEM? If not, what can I do to make sure they do? If the car isn't considered totaled, will his insurance pay for a rental car? If not, what the heck am I suppose to do without a car!? I can't afford a rental on my own.It doesn't even make sense that insurance companies can use aftermarket parts in estimates. There suppose to return the vehicle to the state it was before the accident. The damaged parts are OEM they should replace with OEM regardless of the cars age.

Most of the time a insurance compay will try to get out as cheap as possible. After Market or used if they can find them. If your car is newer or in almost new condition you stand a better chance of getting the OE. Put your foot down and tell them like it is and you will not settle for AM parts. The worst they can do is say no, and if they do threaten to sue them. As far as a rental car goes, have the body shop doing the repairs add it in in the estimate. If they balk, tell em to get you one. Its not your fault some idiot they cover decided to screw up your life.

Depends on how old your car is. If it's a newer car you stand a much better chance of demanding OEM parts. But they do have certified aftermarket parts that are guaranteed to fit properly. It the insurance company wants to use aftermarket, ask what the guarantee is. If it's equal to OEM, you may have to take it.As for the rental, you can certainly ask for that. Well my friend you ask good questions. First make sure the insurance company will pay the body shop. Then make sure the body shop uses only OEM parts. To the best of my knowledge (over 40 years dealing with cars) the insurance company can't make you use after market parts. Make sure they don't send you to a repair shop that they want you to use. Even if they say thats the only way the car will get repaired. You don't have to except that, nor do you have to except their check if its not enough to cover the repairs. As for a rental car if your policy doesn't have the rental coverage your on your own there. As long as you didn't get hurt and you don't have a lawyer helping you, you're on your own. I would not settle for anything that I wasn't total happy with. If you still feel that you are not getting a fare deal from the insurance company then tell them if they don't want to pay for the repairs to be done with OEM parts then you will get a lawyer. Then go get a lawyer, you will get what you want! Good luck...Hope this helps...

As long as your vehicle is under 3 yrs. of age, you can demand that replacement parts be OEM. If your vehicle is older than that, then the insurance companies can opt for aftermarket or salvaged parts in their estimates. You have the right to request OEM parts, but the difference in costs will fall on you. As far as his insurance company paying for a rental car for you, that's a question I'd be asking them. If his insurance company doesn't pay for rental cars, yours might. I'd definitely contact your insurance company and find out what your options are! Insurance companies are very similar to lawyers...let them fight it out on your behalf.
