Default Can this labor contract be enforced in VA?


I signed an employment contract for 1 year with a company (an airline) in VA. The contract states that from the date of hire, I will owe them $16,000, pro-rated over 12 months, if I voluntarily leave. This is to offset training costs. There are no other conditions other than having to terminate my employment voluntarily before the 1-year anniversary of the contract. However, the company has repeatedly not paid me correctly and has disobeyed their own written policies as far as scheduling and pay goes. I love the job but I don't want to deal with this kind of disrespect and having to chase down my money for the next 8 months.Obviously, I know I don't have the contract verbatim on here -- but I know there are a lot of at will laws for labor in VA.

Don't have a final answer, but I can tell you that by violating their own policies they are giving you a weapon. You could use this to your advantage; however, you would need a lawyer. I'm a contractor and fighting the meaning of contract rules is a pain in the neck.

Yes, their violating the terms of their contract could help you in court. BUT, they are a huge corporation with attorneys on payroll, and you will get to pay your attorney up front, and out of your own pocket. Worst case scenario? You quit, can't find a job, have to come up with $5000 or more for an attorney and end up paying the balance of the $16,000.If they are violating payroll laws, contact your state's labor board and file a complaint. But don't quit unless you are prepared to pay the $$$$.Most labor lawyers will consult for free. Take the contract and the reasons you feel they are violating their terms and conditions and go see what an attorney says.good luck
