| Do I have a vaild claim for the small claims court? Jetblue airways cancled a flight after a delay of over 5 hours. The flight was delayed because of the weather, but it was cancled BECAUSE the crew had ran out of time to fly for the day and couldn't find a new crew to fly the plane. We had taxied to the runway and had to turn around because the pilot ran out of time for himself to fly, and they had to cancle the flight for that reason. After the flight was canceled we were Re-booked on a new flight at a different airport over 2 hrs away. We had to rent a car, and stay at a hotel for the night, which most airlines would have taken care of these accomidations. My claim is for 1453.10 for the Tickets, hotel, rent a car, and meals and inconvience we faced on this trip from hell. Do we have a shot at winning this if Jetblue, infact decides to flight this claim. |

| Do I have a vaild claim for the small claims court? Give it a shot, I would. When I was leaving heathrow last year they said that they had overbooked, and offered us 800 dollars to take a later flight. Most airlines are good about things like this, but I would try writing them a letter first. Write a letter a few times, and hang on to all correspondence. They will be helpful in your case if the airline declines to take care of the expenses. |

| Do I have a vaild claim for the small claims court? i doubt you'll get a fight but if you tacked on anything extra aside from actual expenses you probably wont get that paid out. Settling is always better than bad press. |

| Do I have a vaild claim for the small claims court? I'm shocked JetBlue *didn't* cover your incurred additional expenses! Every airline I've ever flown has offered such things when it was necessary. As long as you've kept your receipts and kept a log of events/time, etc., it sounds like you have a good case. I would suggest calling the airline first and giving them the opportunity to reimburse you without going the legal route. Perhaps they have a policy of reimbursment, but you happened to slip through the cracks. In which case, you'd be saving yourself some legal costs if you just resolved it with them directly.Then again, they may have a written policy which precludes the reimbursement of such costs...in which case, you're out the extra dollars if you signed such an agreement (even if you didn't know that's what you were signing). Start with the airline. If they won't reimburse you, then find out if there was a waiver for such circumstances. If not, then take them to court. It's not at all fair that you should be expected to incur nearly $1500 extra for their delays and inability to cover shifts. |

| Do I have a vaild claim for the small claims court? Quite simply NO!! 1.) The cancellation was because of the weather untimately. The flight crew expired because the weather had put JFK into a Ground Delay Program and Ground Stops all day long. Planes of all airlines were cancelling and delaying flights for hours. It's not just JetBlue that did this to customers.2.) JetBlue has a Bill of Rights. You got rebooked, and you will receive a voucher for the onboard delay while waiting.Visit www.jetblue.com/promise to see the details of the Bill of Rights.3.) Airlines are NOT obligated to pay for expenses for renting a car, hotel, or anything else related to a weather event or cancellation. You can bet your ass that if the plane would have been cancelled because of maintenance or something else regarding the jetBlue operation, then it would be JetBlue's responsibility.4.) I was also stranded at JFK when this stuff happened a few days ago. Trust me, you are not the only person who feels they are entitled to some sort of compensation. 5.) Airlines have tons of lawyers. If you even tried to take this to court, the airlines would drown you with supressions that would cost you a fortune to pay a lawyer to sift through. You'd be in a lot of debt before you even get a chance to see a judge. Again, I've seen this stuff personally.6.) And finally, more than likely you chose to rebook for that flight in another city (perhaps BOS, or IAD). Jetblue agents don't just book that for you. You could have gotten rebooked on the next flight on JetBlue with availability that was flying out of JFK. On a final note. This is the worst summer since 1999 for flying. With every major airport busting at the seams with congestion, even a slight drizzle will send delays rippling through the system. I do understand what you are going through. As a frequent flyer, I go through this multiple times a week. The delays on top of having my luggage missing. But the bottom line is that we can't change the FAA's rule about 16 hour days for flight crews and we certainly can't control the weather. | Do I have a vaild claim for the small claims court? Have you checked the fine print on your ticket? I would be surprised if you had a claim because the airlines are soooo careful about wording the fine print to avoid any liability. What travel insurance did you have and does it cover additional costs associated with delays? |

| Do I have a vaild claim for the small claims court? I wouldnt recommend fighting this....might give you more trouble or problems and you might end up losing and getting nothing in return. You dont really have a strong case since the cancellation was due to something that the airline couldnt control. I am starting to wonder if you were the one that asked to be rebooked at another airport more than 2 hours away, the one that rented the car and hotel. Pretty much every ticketing agent would rebook you on a flight departing from the same airport. oh and BTW, if you do try and fight this (even though i strongly dont suggest it), scratch that "meals" part of. MEALS ARE YOU RESPONSIBILITY and the cost should come out of your pocket because you chose to eat whatever you ate. Besides, Jetblue doesnt serve meals on their flight, so you wouldnt have gotten a mean on there anyways. |

The Conditions of Carriage that you agree to without knowing it whenever you buy a ticket absolve the airline of all responsibility when the delay or cancellation is due to a situation out of their control. Even though the problem was crew legality, it was caused by weather. Your best bet is to contact the airline's customer relations department. A judge would throw it out automatically. |
